Vermont Court System

Within the Vermont judicial branch, there is one federal district court, a state supreme court, and trial courts.  Court Links:

The Supreme Court serves as the appellate court for the Vermont Judiciary. Additionally, the Vermont Superior Court is one of its trial courts. Each county is represented by one of the Superior Court’s 14 divisions. Civil, criminal, environmental, family, and probate are the five divisions of the Superior Court. Additionally, the Superior Court maintains a Judicial Bureau with statewide authority. Each of these courts plays a particular part in delivering justice.

Trial courts:

Superior Court

Cases from state courts and agencies are reviewed by the Supreme Court. They are known as “appeals.” The Judicial also oversees the court system and establishes procedural guidelines for use in state courts.

 

Civil Division

The Superior Courts in each of Vermont’s 14 counties are divided into four different divisions. The Civil Division is a trial court where civil cases involving contract breaches, evictions, foreclosures, land disputes, wrongful death claims, and personal injuries are heard.

Criminal Division
Each county in Vermont has a criminal division courthouse, also referred to as the Criminal Court. Through jury trials, court trials, and guilty pleas, a superior court judge evaluates a person’s guilt or innocence when they are accused of a crime.

Environmental Division

The Environmental Division is a statewide court that deals with various aspects of environmental law such as  municipal and state land use

Family Division
Each of Vermont’s superior courts has a family division. All family-related legal issues are handled by each family division. In the family division, decisions are made about parentage, divorce, separation, civil union dissolution, and other issues. Custody and child support are also decided here.

Probate Division

The Superior Court’s Probate Division handles adoptions, emancipation, guardianships, non-resident clergy performing marriages, correction and establishment of birth, death, and marriage records, and probate of estates, trusts, and wills.

Judicial bureau

The Judicial Bureau has statewide jurisdiction over civil violations.
